Euthanasia, the state of the debate. Speakeasy a cura di Alessia Ruffini, Gaia Galeazzi e Sara Simonazzi

In recent years, the problems raised by euthanasia have received great media interest, and are still the subject of lively discussions, both from political and religious subjects and in the scientific world.

Euthanasia is a form of assisted suicide practiced consensually on people suffering from incurable diseases in order to avoid their continuous suffering. This practice can be implemented through different forms: active,  passive or voluntary euthanasia.  Going into detail, by active euthanasia we mean when drugs that cause death are administered because in these cases the suspension of therapies would not be sufficient to cause death.  By passive euthanasia we mean the interruption of therapies and as a consequence natural death is not prevented but promoted.  Voluntary euthanasia means when the doctor acts at the explicit request of the patient who wants to put an end to his/her life.

Both public opinion and the political class are divided on the issue of euthanasia: the religious part is obviously opposed because, according to the values ​​of Christianity, life is a gift from God and only he can choose when to end it;  the non religious want to defend the quality of life even at the cost of granting euthanasia.

 Each country has different values ​​and moral principles, in fact each of them independently decides how and whether to apply this form of assisted suicide.  The first law legalizing euthanasia was passed in April 2001 in the Netherlands, which became the first country in the world to allow euthanasia and assisted suicide.  As for our country, Italy, euthanasia is considered a crime.

We have decided to deal with a case that sparked a great deal of debate in Italy.  The case in question is that of Eluana Englaro, an Italian woman, who, due to a road accident, lived in a vegetative state for 17 years. This condition excludes awareness of yourself and the surrounding world and the possibility of communicating or interacting in any way with the external environment.The family asked the doctors to interrupt the treatment, reporting that their daughter had repeatedly stated that she did not want useless therapeutic treatment, and when the case ended up in court the state opposed their request.

 The accident occurred on January 18th 1992, when Eluana crashed into a light pole and immediately afterwards into a wall when she was returning from a party.  Because of the crash, she suffered very serious head injuries and a fracture of the second vertebra which caused immediate paralysis of the 4 limbs.  When help arrived Eluana was already in a coma and she remained in this state for a few months until she woke up but then, due to irreversible brain injuries, she was declared to be in a vegetative state.  Following a new appeal from her father, the Court of Cassation established that there were two conditions to be fulfilled in order to allow the interruption of artificial feeding; the first was that the condition of the vegetative state was irreversible and that there was not even the slightest possibility of  recovery of consciousness, while the second says that it is necessary to demonstrate with clear and convincing evidence that this was the will of the patient before the state of unconsciousness.

The Court of Appeal of Milan, after having ascertained the presence of the latter, authorized the girl's father to interrupt hydration and forced feeding treatment that kept Eluana alive due to lack of recovery of consciousness. On April 8, 2016, a ruling by the TAR condemned the Lombardy region to pay very high compensation for damages following the decision taken by Roberto Formigoni, at the time president of Lombardy, to prohibit the suspension of therapies.

The story of Eluana Englaro opened a debate on issues related to euthanasia: there were two opposing opinions, on one side the Catholic public opinion which declared itself opposed to the interruption of life and on the other the secular public opinion which was in favor of respecting the will of the person directly concerned.

Many other events concerning euthanasia still trigger numerous debates and for this very reason, we have decided to deal with this issue so that there is more information on delicate topics such as these.

EUTANASIA, COME STANNO LE COSE?

Negli ultimi anni il problema sollevato dall'eutanasia ha ricevuto un grande interesse mediatico, ed è tuttora oggetto di vivaci discussioni, sia da parte dei soggetti politici e religiosi che nell'ambito del mondo scientifico.

L'eutanasia è una forma di suicidio assistito praticato in modo consensuale su persone affette da malattie incurabili per poter evitare loro continue sofferenze. Possiamo dire che questa pratica può essere messa in atto attraverso forme diverse: eutanasia attiva, passiva, volontaria. Entrando nel dettaglio, per eutanasia attiva si intende quando vengono somministrati dei farmaci che procurano la morte al paziente malato perché in questi casi la sospensione delle terapie non sarebbe sufficiente per provocarne la morte. Per eutanasia passiva si intende l'interruzione delle terapie e di conseguenza, non si impedisce ma si favorisce la morte naturale. Per eutanasia volontaria si intende quando il medico agisce su richiesta esplicita del malato che vuole porre fine alla propria vita.

Sia l'opinione pubblica che la classe politica sono divise sul tema dell'eutanasia: la parte religiosa è ovviamente contraria perché, secondo i valori del cristianesimo, la vita è un dono di Dio e solo lui può scegliere quando farla terminare; i laici, contrariamente ai religiosi, vogliono difendere la qualità della vita anche a costo di concedere l'eutanasia.

Ogni stato ha dei valori e dei principi morali diversi, per l'appunto ognuno di essi decide autonomamente come e se applicare questa forma di suicidio assistito. La prima legge che legalizza l'eutanasia è stata approvata nell'aprile del 2001 in Olanda, che è diventato il primo paese al mondo a consentire l'eutanasia e il suicidio assistito. Per quanto riguarda il nostro paese, in Italia, l'eutanasia è considerato un reato.

Abbiamo deciso di trattare di un caso che scatenò in Italia un particolare dibattito riguardante la questione dell’eutanasia. Il caso in questione è quello di Eluana Englaro, una donna italiana che a seguito di un incidente stradale si trovò a vivere in stato vegetativo per 17 anni, condizione che esclude la coscienza di sé e del mondo circostante e la possibilità di comunicare o interagire in alcun modo con l'ambiente esterno.

La famiglia chiese ai medici l’interruzione del trattamento riportando loro che la figlia aveva ripetutamente affermato di non desiderare inutili accanimenti terapeutici e quindi, in seguito a questo, vi fu un processo in quanto lo stato si oppose alla loro richiesta.

L’incidente avvenne il 18 gennaio 1992, quando, al ritorno da una festa, Eluana si schiantò contro un palo della luce e subito dopo contro un muro. In seguito allo schianto riportò lesioni craniche molto gravi e una frattura della seconda vertebra che provocò l’immediata paralisi dei 4 arti. Quando i soccorsi arrivarono Eluana era già in coma e rimase in questo stato per alcuni mesi fino a quando non si risvegliò, ma poi, a causa di lesioni cerebrali irreversibili, venne dichiarata in stato vegetativo. A seguito di un nuovo ricorso del padre la Corte di Cassazione stabilì che vi fossero due presupposti necessari per poter consentire l’interruzione dell’alimentazione artificiale. Il primo era che la condizione di stato vegetativo fosse irreversibile e che non ci fosse la minima possibilità di un recupero della coscienza, mentre con il secondo bisognava dimostrare con prove chiare e convincenti che questo fosse il volere del paziente prima del suo stato di incoscienza. La corte d’Appello di Milano, dopo essersi accertata  della presenza di quest'ultima condizione, autorizzò il padre della ragazza ad interrompere il trattamento di idratazione e alimentazione forzata che manteneva in vita Eluana per mancanza di recupero della coscienza.

L’8 aprile 2016 una sentenza del TAR condannò la regione Lombardia a pagare un risarcimento di danni molto alto in seguito alla decisione presa da Roberto Formigoni, allora presidente della Lombardia, di vietare la sospensione delle terapie.

La vicenda di Eluana Englaro aprì un dibattito sui temi legati all’eutanasia: vi furono due opinioni contrastanti, da una parte l’opinione pubblica cattolica che si dichiarò contraria all’interruzione della vita e dall’altra parte l’opinione pubblica laica che si dichiarò favorevole in quanto volontà della diretta interessata.

Molte altre vicende riguardanti l’eutanasia scatenano tutt’oggi numerosi dibattiti e proprio per questo abbiamo deciso di trattare di questo tema perché vi sia una maggiore informazione in merito ad argomenti delicati come questi.
